ConfigHub Evaluation License Agreement Version 0.1 — 2026-07-20 This Evaluation License Agreement ("Agreement") is a legal agreement between you, either an individual or a single entity ("Licensee", "you"), and ConfigHub, Inc. ("ConfigHub", "we", "us") governing your use of the ConfigHub server software distributed as a container image and any accompanying documentation (collectively, the "Software"). BY PULLING, INSTALLING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT PULL, INSTALL, OR USE THE SOFTWARE. 1. Status of the Software The Software is pre-release, alpha-quality software provided for evaluation and collaboration with design partners. It is not intended or supported for production use. Features, interfaces, and data formats may change or be removed without notice, and the Software may contain defects. 2. Eligibility and License Grant The Software is made available solely to ConfigHub's design partners. Your license to the Software is conditioned on your having a current, executed non-disclosure or evaluation agreement with ConfigHub (an "NDA"). If you do not have a current NDA with ConfigHub, ConfigHub grants you no license to the Software, and you must not pull, install, or use it. Making the Software publicly accessible for ease of distribution does not grant a license to anyone who lacks a current NDA. Subject to your compliance with this Agreement and your NDA, ConfigHub grants you a limited, non-exclusive, non-transferable, non-sublicensable, royalty-free, and revocable license to pull, install, and run the Software solely for your internal evaluation and for collaboration with ConfigHub during the Term. This is a license to use the Software in object/container form only. It is not a sale, and it conveys no ownership. The Software is made publicly available for ease of distribution; making it publicly accessible does not make it open-source software and grants no rights beyond those stated in this Agreement. 3. Restrictions You will not, and will not permit any third party to: a. redistribute, sublicense, sell, rent, lease, host as a service, or otherwise make the Software available to any third party; b. reverse engineer, decompile, or disassemble the Software, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law; c. modify, translate, or create derivative works of the Software; d. remove, alter, or obscure any proprietary notices, labels, or marks; e. use the Software to develop or assist in developing a product or service that competes with ConfigHub; f. use the Software in any production, safety-critical, or revenue-generating environment, or to process data you cannot afford to lose; or g. publicly disclose benchmark, performance results, or any other details about the Software without ConfigHub's prior written consent. 4. Ownership ConfigHub and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. All rights not expressly granted in this Agreement are reserved. 5. Confidentiality The Software is pre-release and constitutes ConfigHub's confidential information. You will protect it using at least the same care you use for your own confidential information of like importance, and will not disclose any non-public characteristics of the Software (including defects, designs, and undocumented behavior) without ConfigHub's prior written consent. Your NDA with ConfigHub governs the treatment of ConfigHub's confidential information. This section is in addition to, and does not limit, your obligations under that NDA; in the event of a conflict between this section and your NDA, the NDA controls. 6. Feedback If you provide ConfigHub with suggestions, evaluations, or other feedback, you grant ConfigHub a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback for any purpose without obligation to you. 7. Third-Party Components The Software includes third-party open-source components licensed under their own terms. Those terms govern your use of those components and, to the extent of any conflict with this Agreement, control with respect to those components. The notices and license texts for these components are included in the container image: /srv/app/THIRD_PARTY_LICENSES.txt for the server's Go modules, /srv/app/UI_THIRD_PARTY_LICENSES.txt for the npm packages bundled into the embedded web UI, and /srv/app/OS_LICENSE_NOTICE.txt for the operating-system packages in the base image, including a written offer for the corresponding source of GPL-licensed components. 8. No Warranty THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CONFIGHUB DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. 9. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONFIGHUB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY. CONFIGHUB'S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED USD $100. BECAUSE THE SOFTWARE IS PROVIDED AT NO CHARGE FOR EVALUATION, THESE LIMITATIONS ARE A FUNDAMENTAL BASIS OF THE BARGAIN. 10. Term and Termination This Agreement begins when you first pull or use the Software and continues until terminated (the "Term"). ConfigHub may terminate this Agreement or your license at any time. The Agreement terminates automatically if you breach it, and automatically upon the expiration or termination of your NDA with ConfigHub. Upon termination, you must stop using and delete all copies of the Software. Sections 3 through 9 and 11 survive termination. 11. General This Agreement is governed by the laws of the state of Delaware, USA, without regard to conflict-of-laws rules. The state and federal courts located in the State of Delaware have exclusive jurisdiction and venue over any dispute arising out of or relating to this Agreement or the Software, and each party consents to the personal jurisdiction of those courts. If any provision is held unenforceable, the remaining provisions remain in effect. This Agreement, together with your NDA, is the entire agreement between the parties regarding the Software and supersedes prior understandings. A separate signed commercial, non-disclosure, or evaluation agreement between you and ConfigHub controls over this Agreement to the extent of any conflict. Contact: legal@confighub.com
